<em>To the barricades: Mahoney is pro-life, anti-fence.</em></p>
<p>On  Tuesday, June 8, the Rev. <strong>Patrick Mahoney</strong> arrived at Planned Parenthood  with the intention of <a href="http://www.washingtoncitypaper.com/blogs/sexist/2010/06/09/anti-abortion-activist-gets-arrested-attention/">going to jail over a fence</a>.</p>
<p>Two months  earlier, the District had granted the organization a permit to build a  42-inch-high “wrought iron steel fence” around the front lawn of its  clinic at 1108 16th St. NW. When Mahoney learned of the construction, he  notified police, press, and fellow activists; marched onto the lawn;  and knelt to pray in hopes of getting handcuffed.<span id="more-10955"></span></p>
<p>Landscaping changes  rarely prompt civil disobedience. Mahoney, a Presbyterian minister and  longtime anti-abortion activist, is more concerned with what lies beyond  the fence: a grassy, 40-foot-long entryway with a paved center walk  that leads to the clinic, where the services include abortions. The turf  has historical significance for Mahoney: For years, he and his allies  have come to the yard to pray, confront patients, and attempt to  convince pregnant women not to abort.</p>
<p>The new barrier, equipped with  signs reading, “Private Property. No Trespassing. Violators Will be  Prosecuted,” is meant to keep the anti-choicers at a distance. But it  also provides an opportunity for Mahoney to pursue his second-favorite  activity involving the property in front of the clinic: litigation.</p>
<p>Before  Mahoney staged his public prayer, he brought in his go-to attorney,<strong> James Henderson </strong>of the American Center for Law &amp; Justice. Henderson  investigated the issue with city officials and uncovered city maps  indicating that the 40 feet between Planned Parenthood’s doorway and the  16th Street sidewalk is zoned as “public space.”<br />
Clinic reps  maintain that the property is theirs to police. “The fence serves to  protect the health center and our patients from violations of D.C.  trespassing laws while still allowing those who are opposed to legal  abortion to exercise their First Amendment rights and express their  views along the sidewalk,” Planned Parenthood of Metropolitan Washington  CEO<strong> Laura Meyers</strong> said in a statement.</p>
<p>D.C. police concurred,  enabling Mahoney his photogenic arrest. “At this point, our attorneys  have advised us that they do consider it private property inside the  fence line, so if you go inside the fence line, you will be encroaching  upon private property,” Cmdr. <strong>Hilton Burton</strong> informed Mahoney shortly  before his planned prayer. Mahoney prayed anyway, Burton arrested him,  and the reverend promised to pursue the issue in court.</p>
<p>Indeed,  Mahoney rarely misses the opportunity for a court appearance. In 2000,  he sued the Supreme Court over a decision banning large picket signs  from sidewalks on the high court’s grounds, thus preventing his  entourage from toting what the <em>Washington Post</em> described as a gigantic  “full-color depiction of a decapitated fetus.” In 2005, he sued the U.S.  Marshals Service for the right to picket in favor of the Ten  Commandments in a restricted area opposite St. Matthew’s Cathedral. In  2009, he sued the District for refusing to allow a “chalk art  demonstration” in front of the White House that was meant to slam  President Obama’s “radical support of abortion.”</p>
<p>But Mahoney’s  preferred battleground is Planned Parenthood’s walkway. Over the past 20  years, Mahoney and his colleagues have launched several protracted  court cases asserting their religious freedom to “counsel” those on  their way into the facility.</p>
<p>To local anti-abortion activists, the 40  feet are worth the decades-long battle. “It’s better access,” explains  <strong>Erik Whittington</strong> of Rock for Life, an anti-abortion initiative targeted  at teens. Whittington says he’s prayed outside the clinic “at least once  a year” since 1995. “I’ve been up there next to the door; I’ve been up  on the grass leading prayer circles,” he says. “For women who are coming  here to have an abortion, they’re walking up on that public property  for about 15 seconds...Forty feet is a long way.”</p>
<p>With the fence,  D.C.’s anti-abortion activists are forced to set up shop on the 16th  Street sidewalk, where it’s difficult even to identify women seeking  clinic services until they’re already out of earshot. “You don’t really  have enough time to talk to them that way,” says <strong>Dick Retta</strong>, an activist  who is familiar with the disputed terrain. “Outside the fence, you’ve  only got maybe three to four seconds.”</p>
<p>Back in the ’80s, Mahoney  would commandeer local clinic entrances for days at a time. The dispute  over the Planned Parenthood entryway originated in 1989, when Mahoney  and Christian activist organization Operation Rescue staged a series of  “rescue” missions “involving physical blockades” that prevented access  to several local health centers. In response, District Court judges laid  down an injunction barring the protesters from “trespassing on,  blockading, impeding or obstructing access to” D.C. abortion clinics.</p>
<p>Since  then, Mahoney has fought a series of injunctions designed to keep him  at a distance from local abortion providers. In 1994, Congress made the  courts’ job easier with the Freedom of Access to Clinic Entrances (FACE)  Act. The measure forced Mahoney to reconsider his tactics. He began, of  course, by challenging the act in court. Later, he settled for  talks—on-site prayer demonstrations and targeted “sidewalk  counseling”—instead of blockades. The idea was to provoke a reaction  that Mahoney could then take to court. After all, what’s a few days in  front of a clinic when you can tie up an abortion provider in litigation  for years?</p>
<p>On Jan. 23, 1998, the day after the 25th anniversary of <em> Roe v. Wade</em>, Mahoney planned one of his arrest-baiting protests at  now-defunct abortion provider the Capitol Women’s Center. When Mahoney  arrived, “volunteers had already created a human chain in front of the  clinic” to assist those entering, according to court documents. Five of  Mahoney’s cohorts took a knee on the center’s sidewalk, at which point  police officers “cordoned off the front of the clinic with police tape.”  Mahoney crossed the line anyway and was arrested for violating FACE. A  court issued a permanent injunction forbidding the minister and his  allies from “coming within a twenty-foot-radius of any reproductive  health facility” located inside the bounds of the Capital  Beltway—including Planned Parenthood.</p>
<p>More recently, Mahoney’s  litigious strategy has been embraced by younger activists. In 2005,  Christendom College student <strong>Daniel Heenan</strong> sued Planned Parenthood after a  tussle with a security guard. In those pre-fence days, the protesters’  no-fly zone was delimited by a spray-painted line on the pavement 20  feet from the clinic. According to court documents, it marked “the  boundaries of an injunction issued by the United States District Court  for the District of Columbia” against—whom else?—a “discrete group of  individuals affiliated with Rev. Patrick Mahoney, who had been found by  that court to have violated the Freedom of Access to Clinic Entrances  Act of 1994.”</p>
<p>Inspired by Mahoney, Heenan had turned up the previous  May intending to cross the boundary. Police were summoned. Pro-choice  volunteers linked arms. Heenan crossed the line. Then, according to  court documents,<strong> Harry James</strong>, a former Metropolitan Police Department  officer working as a clinic security guard, “placed one hand on Heenan’s  collar and another on his belt” and “attempted to turn Heenan around  and walk him away from the building.” At some point in the commotion,  “Heenan fell to the ground, and James tumbled over him.”</p>
<p>Heenan,  also represented by Henderson, asked for $35,000. He lost in court. But,  just like Mahoney’s suit, the ruckus took up a little bit of Planned  Parenthood’s time and energy and money, which was kind of the point.</p>

Tomorrow,<strong> Fred Phelps</strong> and his <a href="http://www.godhatesfags.com/">Westboro Baptist Church</a> will be protesting the first day of same-sex marriage in the District. Why? Well, <a href="http://www.godhatesfags.com/schedule.html">because</a> "God hates fags!  God hates fag-enablers! Ergo, God hates District of Columbia, all of DOOMED  america, and the World! You've turned the country over to the fags; now your  soldiers/fire fighters/cops/kids/parents/etc. are coming home in body bags!  Judges 19-21. Praise God! Amen."</p>
<p>One District resident has dared to defy this logic. <strong>Bridget Todd</strong> is organizing <a href="http://www.facebook.com/event.php?eid=340208638672&amp;ref=mf">a Phelps counter-protest</a> from 11-12 p.m. tomorrow outside of <a href="http://www.dccourts.gov/dccourts/index.jsp">D.C. Superior Court</a>. Todd also intends to challenge the creative signage of the most flamboyant hate group around ("Bitch Burger"?). <p>Todd, who will have extra markers and cardboard on-hand outside the courthouse, says that crafting a great counter-protest sign often requires you to actually observe the protest first. "I think it'll be more effective to scope out the scene and then come up with a sign based on the situation," she says. But there are a few old standbys you can whip up in advance:</p>

<p>Just make fun of the way they look! You know they're <a href="http://thefbomb.org/2009/11/corduroy-skirts-are-a-sin/">going to look kind of weird</a>. Remember, these people think you are murdering American soldiers through some sort of ho-mo-sexual voodoo, so rules of decorum are pretty much out the window here. "Of course, a good old fashioned catty remark sign can really never go wrong," Todd says.</p>
<p><strong>EMBRACE ABSURDITY.</strong></p>
<p>You're dealing with people who will likely be carrying around signs showing aborted fetuses served up inside Big Macs, so you're going to have to think outside the box a little bit. "I can't say enough good about funny 'that makes no sense at all' signs that just point out how absurd these people are," Todd says.Protest whatever! A friend,  <a href="http://www.kylestoneman.com/"><strong>Kyle Stoneman</strong></a>, is a ridiculous protest veteran who has previously staged a successful Phelps-style <a href="http://www.youtube.com/watch?v=dYfHXXGJHKk">protest of forks</a> "(Did Jesus DIE for your FORK? NO!"):</p>

<p>Try to be as weird as possible. "I've got one more sign idea that I'd like to do at some point," says Stoneman. "The sign says 'Coat Room,' and the person holding this sign should be wearing half a dozen to a dozen coats."</p>

<p>The Archdiocese of Washington has been <a href="http://www.washingtoncitypaper.com/blogs/sexist/2009/11/18/guide-to-gay-wedding-discrimination/">battling the D.C. government</a> for the right to discriminate against gays and lesbians since D.C.'s same-sex marriage legislation got rolling last year.</p>
<p>One major point of contention: Once gays and lesbians are allowed to marry, the Archdiocese&#8212;which employs plenty of locals through <a href="http://www.catholiccharitiesdc.org/">Catholic Charities</a>&#8212;will be required to provide health benefits to same-sex spouses, an act which it says would fly in the face of the Catholic church's teachings on homosexuality.</p>
<p>The solution? No spousal benefits for <em>anybody</em>.</p>
<p><span id="more-9051"></span><br />
Today, Catholic Charities President and CEO <strong>Edward Orzechowski</strong> sent out a memo to staffers informing them of the change to the health care coverage, which will go into effect tomorrow.</p>
<p>In short: If you and your spouse are already enrolled in Catholic Charities health coverage, your spouse will be grandfathered in. Starting tomorrow, however, new employees (or newly married employees, <a href="http://www.washingtoncitypaper.com/blogs/sexist/2010/02/26/gay-and-getting-married-nextxt-week-bring-35-work-the-security-line-and-avoid-fred-phelps/">hint hint</a>) will not be allowed to add spouses to the plan. So: Longtime employees will receive the spousal benefits they've always had; Catholic Charities will get to keep its pool of covered spouses gay-free; only fresh employees and gays will feel the sting on this one.</p>
<p>Here's the memo:</p>
<blockquote><p>I am writing to you to inform you of an important change to our group health care benefit plan that will take effect on March 2, 2010 due to a change in the law of the District of Columbia. It is important to note that the existing health coverage of current employees will not be affected by the change. New employees and current employees requesting revisions in benefit coverage will be affected by this change.</p>
<p>Catholic Charities will continue to honor the health plan coverage that current employees have as of March 1, 2010. As of March 2, a new plan will be in effect that will cover new employees and requests for benefit changes by current employees. The new plan will provide the same level of coverage for employees and their dependents that you now have, with one exception: spouses not in the plan as of March 1, will not be eligible for coverage in the future. If your spouse currently has coverage in our Plan, he/she may continue to be covered by the health benefit plan, even if you later add a dependent or decide to change your option level (e.g., change from low option to high option). Please see the attached formal Plan Amendment.</p>
<p>We sincerely regret that we have to make this change, but it is necessary to allow Catholic Charities to continue to provide essential services to the clients we serve in partnership with the District of Columbia while remaining consistent with the tenets of our religious faith.</p>
<p>A summary of the Plan modification has been mailed to you at your home address. If you have any questions on this matter, please e-mail your Human Resources manager or, if you do not have access to email, call. Please remember, this change does not impact your current coverage in any way.</p>
<p>Thank you for your understanding in this matter, and let me again express my appreciation for your support and patience over these past months as we have worked hard to arrive at a decision that allows us to continue to serve others in a manner that is consistent with our religious beliefs.</p></blockquote>

It's called the <a href="http://stuffchristianslike.net/2008/04/106-the-side-hug/">The Christian Side-Hug</a>, and it's here to help the devout avoid the temptation of full frontal hugging. Don't worry&#8212;it's cool, because they made a "rap" song about it.</p>

<p>According to<strong> Stuff Christians Like,</strong> there's no "exact scripture reference" banning normal hugging. But the Side-Hug does significantly lower the "risk of two crotches touching," which has got to be in the Bible somewhere. Here's how you do it:</p>
<blockquote><p>Instead of face to face, you go side to side, putting your arm around the person and your hip against their’s. Still having a hard time mastering it? Pretend you’re taking a photo and you’re both looking at the camera together. The side hug, or A frame as it is also called, is safe for the whole family, friendly and above all holy.</p></blockquote>
<p>The Christian Side-Hug strikes me as almost skeezily chaste&#8212;I'd much rather have a brief normal embrace with a stranger than a hip-tap from a person who I know sexualizes even the most mundane forms of human contact. But the Side-Hug itself is slightly less offensive than the medium being used to promote it: An appropriated version of "rap music" performed by a bunch of white youth pastors who think that mixing in some  gang-ish hand signals, tying on a bandana, and securing some fake bling will bring the youth to God.</p>
<p>The Christian Side-Hug rap comes courtesy of the <a href="http://egconference.org/">Encounter Generation Conference</a>, an annual Christian youth gathering which hopes to "bring the power, authenticity, and relevance of Jesus Christ to their culture." I'm afraid that this potent combination of absurd chastity and mock hip-hop will be more likely to bring the power of a school-yard beat-down to these kids' faces.</p>

Catholic Block: Church fights to keep weddings swinging one way.</strong></p>
<p>The authors of the D.C. gay marriage bill are sensitive folks. While they’re eager to grant gays and lesbians the right to get hitched in the District, they don’t want to upset conservative churches in town. So they threw an exemption into the pending <a href="http://www.glaa.org/archive/2009/b18-482committeeprint1110.pdf">gay-marriage bill</a> [PDF]: No church will be obligated to wed same-sexers. It’s a ceremonial loophole that’s not nearly wide enough for the D.C. arm of the Catholic Church. “The language of the bill only protects us on the day of,” says<strong> Susan</strong> <strong>Gibbs</strong>, communications director for the Archdiocese of Washington. “But for us, that day is the launching point for the rest of your life. It’s not a day-long event. It’s a life-long journey.”</p>
<p><span id="more-7582"></span></p>
<p>Translation: The <a href="http://www.adw.org/home.asp">Archdiocese</a> wants to discriminate against gays and lesbians for much longer than just 24 hours. And that’s their problem with the legislation—same-sex spouses must be treated equally over the course of that life-long journey, for purposes of hiring practices, employment benefits, and adoption.</p>
<p>Yet for that one glorious day, when those bells chime, discrimination rules! The legislation says any “religious society, or a nonprofit organization which is operated, supervised, or controlled by or in conjunction with a religious society” may deny same-sex couples any “services, accommodations, facilities, or goods for a purpose related to the solemnization or celebration of a same-sex marriage.”</p>
<p>So just what sort of “services, accommodations, facilities, or goods” can be safely withheld here? The following is your guide to Legal Same-Sex Wedding Day Discrimination.</p>
<p>•    <strong>PIANISTS.</strong> The “facility” exemption prevents a church opposing same-sex marriage from providing its religious sanctuary for the wedding. But what goods and services are we talking about? The goods and services provision prevents a crafty same-sex couple from walking into a house of God and demanding everything but the church hall for the purpose of their ceremony: From the in-house organist playing “Here Comes the Bride” to the Bibles used to recite Colossians 3:18: “Wives, submit to your husbands, as is fitting in the Lord.”</p>
<p><strong>Russell J. Weismann</strong>, Georgetown University’s director of music and liturgy, serves as the organist for all <a href="http://campusministry.georgetown.edu/programs/Weddings/">weddings performed on campus</a>. The Yale-, Duquesne-, and Carnegie Mellon–educated pianist doesn’t play for just anyone: Besides not being gay, couples who march down the aisle to Weismann’s tune must also be Georgetown students, alumni, faculty, or staff. The religious exemption, then, ensures that Weismann’s services won’t need to be legally extended to a couple of Catholic, Georgetown-educated gays who are either serious Weismann fans, or are just trying to make a point.</p>
<p>Councilmember <strong>Phil Mendelson</strong>, who <a href="http://www.dccouncil.washington.dc.us/mendelson/">chairs the committee</a> that finalized the bill’s language, says that goods and services are included in the religious exemption in order to prepare for just such unlikely scenarios. “If a same-sex couple went to a Catholic church, the bill says the church does not have to perform their wedding,” says Mendelson. “But what if the same-sex couple says, ‘We won’t hold our wedding in your sanctuary, but we want to use your Bibles and candles’? If ‘goods and services’ were omitted from the language, the church could be sued over the Bibles and the candles.” And the pianist.</p>
<p>•    <strong>SOUL FOOD.</strong> Saint’s Paradise, a divine <a href="http://www.washingtonian.com/blogarticles/Food%20&amp;%20Dining/bestbites/5261.html">cafeteria-style restaurant</a> located at 601A M St. NW, is the perfect spot for a rehearsal dinner in the heart of overpriced, overcrowded downtown D.C.: It’s got family-sized tables, free cornbread, and a very pleasant view of the baptism fountain of the <a href="http://tuhopfap.org/">United House of Prayer for All People</a>. The church, true to its name, doles out its extra-sweet candied yams to churchgoers and the general public alike.</p>
<p>That “all people” invitation doesn’t extend to weddings. Pastor<strong> Herbert Whitner </strong>clarifies the church’s position on gay marriage: “We don’t agree with that,” Whitner says. Same-sex celebrations aren’t exactly welcome on United House of Prayer property.</p>
<p>Rehearsal dinners, however, aren’t strictly a day-of event—they’re more of a night-before kind of thing. Mendelson says the cafeteria’s physical proximity to the church—the restaurant is at 601A, the house of God is at 601—allows the United House of Prayer to deny all wedding-related celebrations, regardless of their timestamp. “I think they could turn away the rehearsal dinner,” Mendelson says. “That’s because it is in the church. It’s a part of the church facility. And since the rehearsal dinner is part of the celebration of marriage, they would be able to say no.”</p>
<p>•<strong> “SOMETHING OLD.” </strong>The <a href="http://www.salvationarmyusa.org/usn/www_usn_2.nsf">Salvation Army</a>’s sole District shop, located in Northeast’s H Street corridor, wouldn’t be high on the list of any couple’s wedding destinations. Its aisles are a bit cluttered for a procession, seating is limited, and the place smells kind of weird.</p>
<p>What some engaged couples may not know: Beyond its work recycling consumers’ castaways, the Salvation Army is a real functioning Christian church with a penchant for military jargon. Their ministers—“officers” in the Army’s ranks—can be ordained to perform marriages for both Salvationist and non-Salvationist couples. <a href="http://www1.salvationarmy.org.uk/uki/www_uki_ihc.nsf/vw-sublinks/22F04FCCD805459B8025704B0047BB0A?openDocument">Salvationist marriages</a> are less than traditional. Ranking Salvationist officers are allowed to marry <a href="http://www.salvationarmyusa.org/usn/www_usn_2.nsf/vw-dynamic-index/74BBD587C6A63FF585257435005C7EF0?Opendocument">only other officers</a>. Cake is allowed, so long as the couple says grace before the meal, but alcohol is forbidden. Some Salvationists choose to marry in full Army regalia, but the traditional white wedding dress is acceptable, as well. And since the Salvationist moral code is all about giving back, it’s not unlikely that one of these Salvationist ceremonies will lead to one slightly worn, dirt-cheap white dress gracing the racks at <a href="http://dc.kudzu.com/merchant/1551249.html">1375 H St. NE</a>.</p>
<p>Since a wedding dress is a good that’s used in the celebration of a same-sex marriage, and the Salvation Army’s religious beliefs clarify that “sexual intimacy is understood as a gift of God to be enjoyed within the context of heterosexual marriage,” would the Army’s thrift store be forced to sell a wedding dress for a gay wedding?</p>
<p>Mendelson says that a religious-owned thrift shop is too removed from the actual church, and a wedding dress purchase too removed from the ceremony, for the exemption to apply to wedding-related retail: “The bill is intended to establish equality for same-sex marriage. If we have exemptions in the sale of wedding dresses, in the baking of wedding cakes, in catering, in photography, then we have a separate and not equal situation.”</p>
<p>Besides, how would the Salvation Army know that the wedding dress is to be used for a same-sex ceremony? “For wedding dresses to be covered, we’d have to allow the checker at the store to say, ‘I’m offended that you’re homosexual so therefore I will not sell you the wedding dress,’” says Mendelson. “A wedding dress could be a part of a Halloween costume. You can’t just stop anyone who is a part of a same-sex couple and say, ‘No, you can’t buy that.’”</p>
<p>Since the Salvation Army hasn’t adopted “don’t ask, don’t tell” as a part of its military shtick, it’s possible that the organization’s thrift shops will not hold their peace in the face of a same-sex marriage dress-fitting. This situation—the Salvation Army making policy out of denying white dresses to same-sex couples—is about as likely as a couple of gay men suing Georgetown over its pianist. Then again, in 2001, the Salvation Army <a href="http://www.nytimes.com/2001/07/11/us/charity-is-told-it-must-abide-by-antidiscrimination-laws.html?pagewanted=all">privately called upon the Bush administration</a> to help the organization discriminate against gays and lesbians in hiring. Who’s to say the Army won’t take this opportunity to deny an affordable wedding dress to a lesbian?</p>

<blockquote><p>Notwithstanding any other provision of law, a religious society, or a nonprofit organization that is operated, supervised, or controlled by or in conjunction with a religious society, shall not be required to provide services, accommodations, facilities, or goods for a purpose related to the solemnization or celebration of a same-sex marriage, or the promotion of same-sex marriage through religious programs, counseling, courses, or retreats, that is in violation of the religious society’s beliefs. A refusal to provide services, accommodations, facilities, or goods in accordance with this subsection shall not create any civil claim or cause of action, or result in a District action to penalize or withhold benefits from the religious society or nonprofit organization that is operated, supervised, or controlled by or in conjunction with a religious society.</p></blockquote>

			<content:encoded><![CDATA[<p style="text-align: left;">Last month, I <a href="http://www.washingtoncitypaper.com/blogs/sexist/2009/10/22/in-defense-of-dc-domestic-partnerships/">argued against the provision</a> in the D.C. same-sex marriage bill that would phase out domestic partnerships. In short: A lot of couples, gay and straight, don't want to have to opt into that problematic "marriage" business in order to secure our rights. Marriage still comes with a lot of unwanted shit, like an implicit reinforcement of outdated religious and social implications, not to mention our grandmothers' expectations for a big 'ol wedding.</p>
<p style="text-align: left;">Good news: Yesterday, a revised draft of the marriage bill was released that will retain domestic partnerships (for now, at least). Bad news: the revised bill also allows churches to refuse to make their facilities available for those same-sex couples who actually are into that whole "marriage" business.</p>
<p style="text-align: left;"><span id="more-7423"></span></p>
<p style="text-align: left;">The <em>Washington Blade</em> <a href="http://www.washblade.com/thelatest/thelatest.cfm?blog_id=28016">reports on the DP "tweaks"</a>:</p>

<p style="text-align: left;">During the committee’s two days of hearings, Catania said he was open to removing language he placed in the bill that called for ending the city’s registration of new domestic partnerships after January 2010. Catania noted that he put the provision in the bill because most states that have legalized same-sex marriage have ended existing domestic partnership or civil unions programs on grounds that most same-sex couples prefer marriage.</p>
<p>But a number of witnesses, including officials with the Gay &amp; Lesbian Activists Alliance and lesbian rights attorney and American University law professor Nancy Polikoff, urged the Council to remove the “sunset” clause for domestic partnerships from the marriage bill. These witnesses suggested that the Council take up the domestic partnerships issue at a later date and through separate legislation.</p></blockquote>
<p style="text-align: left;">Right now, we're focused on securing marriage equality, and that's an extremely important step. But hopefully, by the time the council gets around to considering domestic partnerships, we'll be able to look beyond marriage and consider our other options on their own merits. Even when same-sex marriages are recognized, we will still need to address how some marriage rights discriminate against those couples and singles who opt out of the institution. Right now, it may be true that "most same-sex couples prefer marriage," but I believe that may begin to change as the institution evolves and more options are made socially acceptable. A lot of people just don't want to get married, period, and they shouldn't have to do so to get their rights.</p>
<p style="text-align: left;">On to the religious side:</p>

<p style="text-align: left;">On the religious exemption provision, Catania’s original bill noted that “a religious organization, association or society, or a nonprofit organization which is operated, supervised, or controlled by” a church or religious group “shall not be required to provide services, accommodations, facilities or goods” for the purpose of performing any marriage “unless the entity makes such services, accommodations, or goods available … to members of the general public.”</p>

<p style="text-align: left;">Seeing as I would never be interested in getting married in one of these God-forsaken places anyway, this language is less important to me personally. But it's extremely unsettling that the council's bill includes an allowance for religious institutions to discriminate against people on the basis of sexual orientation. The provision, at the very least, serves as a reminder that even when same-sex marriage is legal, marriage will still be fucked up in a lot of ways. Why not just opt out and go for a domestic partnership?</p>

<p><a href="http://www.ashleymadison.com/">AshleyMadison.com</a>, an online dating site that facilitates extramarital affairs, has never been too popular among moral conservatives. Earlier this year, <strong>Deroy Murdock</strong> argued on Human Events that Ashley Madison <a href="http://www.humanevents.com/article.php?id=30957">has edged out gay marriage</a> as the number one threat to traditional matrimony. Now, cluck-clucking conservatives won't have to choose between the cheaters and the gays: Ashley Madison has begun marketing itself as a place where the married can pursue their same-sex attractions, too.</p>
<p><span id="more-7226"></span></p>
<p>Ashley Madison's gay (and bi-curious) population is modest, but growing. Worldwide, the agency hosts 4.7 million members seeking extramarital affairs. Of those, only 143,427 are seeking some same-sex action. About two-thirds of Ashley Madison's same-sex seekers are women looking for women; one-third are men seeking men.<span><strong> Noel Biderman</strong>, Ashley Madison's CEO (married, two kids), says that his service provides a necessary sexual outlet for gay men and women who are trapped within the confines of traditional marriage. </span>"There are men and women who, for whatever reason, might have been motivated to pursue a traditional marriage because they did want to build a family," Biderman says. "Unfortunately, in our culture, their sexuality is still at odds with that arrangement."</p>
<p>In an age when marriage equality is gaining serious steam, helping closeted gays escape their repressive straight marriages seems downright altruistic. But Ashley Madison isn't so progressive as to encourage gay men to marry <em>each other</em>. "They're not looking to leave their families," Biderman says of the same-sex contingent. "They're looking to have this on the side." Ashley Madison is not here to release gays from the closet&#8212;it's here to offer them a peek outside before returning them safely to nuclear family life. Meanwhile, it invests in the repression.  "I don’t want to call it ironic, because people who find this ironic assume that we're a home-wrecking service," Biderman says. "We're not. We are a marriage preservation service."</p>
<p>Nobody relies on the preservation of traditional marriage like Ashley Madison. Ashley Madison's motto, "when divorce isn't an option," seems strange in a country where no-fault divorce makes it easy to reset one's relationship status to single. But Ashley Madison is not designed for folks willing to ruin their home lives so transparently. The service relies entirely on secrecy and discretion&#8212;what skeptics might call "lying" and "self-delusion." "This is not a service for people in open marriages," says Biderman. "There are sites out there for the courageous ones&#8212;the swinger couples who have found the courage to say, 'I love you, but I need to do something different in the bedroom,'" he says. Ashley Madison, on the other hand, is for people who "can't voice their sexual concerns to their spouses, because they are terrified of the repercussions," he says. "There's this notion that people who engage in infidelity are lying and deceitful," he says. "But people wouldn’t have to lie if these more realistic sexual options were socially acceptable."</p>
<p>As soon as those "realistic sexual options" are accepted, though, Ashley Madison goes kaput. The service wouldn't be making any money if people weren't terrified of communicating with their spouses. Besides, secrets are hot. Ashley Madison's branding centers around the service as a <a href="http://www.ashleymadison.com/">sexy, hush-hush taboo</a>. Ashley Madison may have built an empire out of facilitating transgressions, but its continued success lies in reinforcing the traditional. Biderman's business will only remain viable so long as its members continue to invest in conservative, heterosexual marriages which reinforce monogamy. "People have told me, 'Oh, you should open Ashley Madison in France,'" says Biderman. "I tell them, 'You know, I don’t think they need me.'"</p>
<p>To date, Ashley Madison has only identified a need in the U.S., Canada, and Australia. In order for the service to expand, Biderman has got to locate other cultures that are currently struggling between the repressive and the progressive. "Places like Brazil offer an interesting dynamic, where infidelity among men is extremely high and among women it's much lower," he says. "There’s no reason to believe you can’t be wildly successful there. There is an incredible opportunity for a global phenomenon."</p>
<p>Biderman's latest campaign to make this an Ashley Madison world has, so far, failed to reach its full potential. "We always thought there would be a marketplace for same-sex affairs, but it's been difficult to cultivate it," says Biderman. "We could probably stretch those legs further, but there are so many obstacles to advertising our brand. We have enough difficulty advertising infidelity&#8212;think about the problems we'd have marketing to same-sex infidelity. I cant even tell you one avenue where I could effectively market that."</p>
<p>Ashley Madison's target demographic &#8212;people who lead conservative lifestyles but secretly yearn for a transgressive kick&#8212;is difficult to target. Social conservatives, remember, are obligated to respond to businesses like Ashley Madison with concern, outrage, and calls for banning. Ashley Madison claims to support the institution of marriage. Other American institutions have proven less than supportive of Ashley Madison. Recently, police kicked a <a href="http://pinewswire.blogspot.com/2009/09/stank-tank-ashley-madison-kicked-out-of_17.html">tanker truck advertising Ashley Madison affairs</a> out of the city of Philadelphia. Earlier this year, an Ashley Madison commercial was deemed <a href="http://www.nydailynews.com/money/2009/01/28/2009-01-28_banned_these_ads_are_too_racy_for_the_su-1.html">too hot for the Superbowl</a>. "We've got the Parent Television Council saying these ads are reprehensible," says Biderman of the Web site's conservative backlash. "There's this huge fear to have any sort of conversation about sex."</p>

<p>As a result, Ashley Madison's marketing strategy has attempted to awkwardly straddle the divide between the conservative and the progressive. In one television spot, targeted toward women, Ashley Madison is offered as an alternative to a life married to a sexist pig. This husband arrives to an anniversary dinner late, leaves early, and in the meantime, ogles other women and implies that his wife is fat. Cheating on this guy practically constitutes a feminist act. The ad targeted at men contains no such progressive bent. In this version, the poor man's wife isn't a jerk&#8212;but she's<em> </em>fat, and she snores, too! This man is encouraged to cheat on his wife for more, shall we say, traditional reasons: he just wants to fuck someone else behind her back. And there's <a href="http://en.wikipedia.org/wiki/Political_scandals_of_the_United_States">nothing progressive about dudes doing that</a>.</p>

<p>Ashley Madison's new PR push advertising same-sex affairs may further alienate the conservative base it requires to stay relevant. Then again, perhaps the gay element is just what Ashley Madison needs to keep conservatives abreast of its services&#8212;and curious about exploring its taboos. Every time a religious conservative declares a sexual practice an <a href="http://www.americandecency.org/archives/ashleymadison-com-a-despicable-company-aggressively-targets-troubled-marriages-and-offers-adultery-options/">affront to human decency</a>, a new conservative kink is born.</p>

			<content:encoded><![CDATA[<p>Yep, <a href="http://www.physorg.com/news164376975.html">nearly every species of animal</a> on God's green earth engages in "same-sex sexual behavior," UC Riverside researcher <strong>Nathan Bailey</strong> reports. In a review published yesterday, Bailey and co-researcher <strong>Marlene Zuk</strong> found that while homosexual behavior spans the Animal Kingdom, the behavior manifests itself differently across species:</p>
<blockquote><p>"For example, male fruit flies may court other males because they are lacking a gene that enables them to discriminate between the sexes," Bailey said. "But that is very different from male bottlenose dolphins, who engage in same-sex interactions to facilitate group bonding, or female Laysan Albatross that can remain pair-bonded for life and cooperatively rear young."</p></blockquote>
<p>So, fruit flies don't know they're gay, bottlenose dolphins are socially gay, the Laysan Albatross are lifelong gays, and human homosexuals are demonized as "unnatural." These findings probably won't change the minds of homophobes who delight in comparing homosexuality to bestiality, but it may do something to fight the argument that <a href="http://media.www.ramcigar.com/media/storage/paper366/news/2004/03/17/Editorialopinion/Gay-Marriage.Is.Unnatural-634712.shtml">gay sex somehow defies nature</a>.</p>

On March 30, Gov. <strong>Tim Kaine</strong> <a href="http://www.vachoose-life.org/">signed the plates</a> into law.</p>
<p>Now, <a href="http://blogs.tampabay.com/buzz/2009/04/crist-dont-like-jesus-plate-dont-buy-it.html">a new proposition</a> would allow Florida drivers to choose Christ. Drivers could also choose Cross In Front of Stained Glass. When the proposed legislation surfaced, Democratic state senator <strong>Nan Rich </strong>urged  Gov. <strong>Charlie Crist</strong> to veto the Jesus plate.</p>
<p>Crist responded that those who didn't want Jesus on their license plates "don’t have to buy one."</p>
<p>Which raises the question: Who<em> wouldn't</em> want Jesus on their license plate? Look how fucking sweet that is! This is a momentous occasion: A vanity plate that both right-wing religious drivers and ironic liberal drivers can both believe in.</p>

<p>New York Governor <strong>David Paterson</strong> <a href="http://www.npr.org/templates/story/story.php?storyId=103166050&amp;ft=1&amp;f=1014">announced today</a> plans to re-introduce an initiative to legalize gay marriage in the state Paterson introduced a similar bill in 2007, which passed the "Democrat-controlled state Assembly passed in 2007 before it died in the Senate," the AP reports.</p>
<p>Spearheading opposition to the bill is Republican State Senator and evangelical pastor <strong>Ruben Diaz</strong>, who called Paterson's timing of the bill "disrespectful." Though Paterson likely introduced the bill in the hopes of riding the coattails of same-sex marriage victories in Iowa, Vermont, and Washington, D.C., Diaz thinks it's actually "a laugh in the face" to Catholics, who just "celebrated the installation of <strong>New York City Archbishop Timothy Dolan</strong>" this week.</p>
<p><span id="more-3604"></span></p>
<p>But to Diaz, Paterson isn't just chuckling at the Catholics with his same-sex marriage initiative; he's  also challenging "every religious person in New York." Says Diaz:</p>
<blockquote><p>"The Jews just finished their holy week. The Catholics just received the new archbishop. The evangelical Christians just celebrated Good Friday and resurrection. He comes out to do this at this time? It's a challenge the governor is sending to every religious person in New York and the time for us has come for us to accept the challenge."</p></blockquote>
<p>Actually, I'd say that Diaz' comments are an insult to every religious person in New York who doesn't ascribe to Diaz' particular idea of faith. It's an insult to every religious person in New York who doesn't believe that faith should be legislated. It is, of course, an insult to every religious person in New York who is gay.</p>
<p>There are many religious leaders who do not oppose gay marriage. I hope the Associated Press gives them the chance to respond.</p>

<p>One caveat: According to the MCC, the bill missteps in <a href="http://capwiz.com/mdcath/issues/alert/?alertid=13073276">actually making Catholic groups adhere to that principle!</a></p>
<blockquote><p>Senate Bill 566 is a transgender rights bill that would codify in law a distinction between one's "gender identity" and one's "assigned sex at birth." The bill is well intentioned and the Church respects the dignity of each individual. However, such a distinction manifests an egregious violation of our society's basic understanding of the human person, and the natural complementarity of the sexes. As written, <strong>the bill does not include protections for religious institutions</strong>, which would be required to comply with the employment and other provisions of the bill in regards to transgendered individuals.</p></blockquote>
<p>Emphasis theirs. Hmm, okay, so the Catholic church rejects discrimination of all kinds, except for its favorite kinds of discrimination, which it just can't quit!</p>

<p><strong>Signing of Stem Cell Executive Order and Scientific Integrity Presidential Memorandum<br />

<p>Today, with the Executive Order I am about to sign, we will bring the change that so many scientists and researchers; doctors and innovators; patients and loved ones have hoped for, and fought for, these past eight years: we will lift the ban on federal funding for promising embryonic stem cell research. We will vigorously support scientists who pursue this research. And we will aim for America to lead the world in the discoveries it one day may yield.</p>
<p>At this moment, the full promise of stem cell research remains unknown, and it should not be overstated. But scientists believe these tiny cells may have the potential to help us understand, and possibly cure, some of our most devastating diseases and conditions. To regenerate a severed spinal cord and lift someone from a wheelchair. To spur insulin production and spare a child from a lifetime of needles. To treat Parkinson’s, cancer, heart disease and others that affect millions of Americans and the people who love them.</p>
<p>But that potential will not reveal itself on its own. Medical miracles do not happen simply by accident. They result from painstaking and costly research – from years of lonely trial and error, much of which never bears fruit – and from a government willing to support that work. From life-saving vaccines, to pioneering cancer treatments, to the sequencing of the human genome – that is the story of scientific progress in America. When government fails to make these investments, opportunities are missed. Promising avenues go unexplored. Some of our best scientists leave for other countries that will sponsor their work. And those countries may surge ahead of ours in the advances that transform our lives.</p>
<p>But in recent years, when it comes to stem cell research, rather than furthering discovery, our government has forced what I believe is a false choice between sound science and moral values. In this case, I believe the two are not inconsistent. As a person of faith, I believe we are called to care for each other and work to ease human suffering. I believe we have been given the capacity and will to pursue this research – and the humanity and conscience to do so responsibly.</p>
<p>It is a difficult and delicate balance. Many thoughtful and decent people are conflicted about, or strongly oppose, this research. I understand their concerns, and we must respect their point of view.</p>
<p>But after much discussion, debate and reflection, the proper course has become clear. The majority of Americans – from across the political spectrum, and of all backgrounds and beliefs – have come to a consensus that we should pursue this research. That the potential it offers is great, and with proper guidelines and strict oversight, the perils can be avoided.</p>
<p>That is a conclusion with which I agree. That is why I am signing this Executive Order, and why I hope Congress will act on a bi-partisan basis to provide further support for this research. We are joined today by many leaders who have reached across the aisle to champion this cause, and I commend them for that work.</p>
<p>Ultimately, I cannot guarantee that we will find the treatments and cures we seek. No President can promise that. But I can promise that we will seek them – actively, responsibly, and with the urgency required to make up for lost ground. Not just by opening up this new frontier of research today, but by supporting promising research of all kinds, including groundbreaking work to convert ordinary human cells into ones that resemble embryonic stem cells.</p>
<p>I can also promise that we will never undertake this research lightly. We will support it only when it is both scientifically worthy and responsibly conducted. We will develop strict guidelines, which we will rigorously enforce, because we cannot ever tolerate misuse or abuse. And we will ensure that our government never opens the door to the use of cloning for human reproduction. It is dangerous, profoundly wrong, and has no place in our society, or any society.</p>
<p>This Order is an important step in advancing the cause of science in America. But let’s be clear: promoting science isn’t just about providing resources – it is also about protecting free and open inquiry. It is about letting scientists like those here today do their jobs, free from manipulation or coercion, and listening to what they tell us, even when it’s inconvenient – especially when it’s inconvenient. It is about ensuring that scientific data is never distorted or concealed to serve a political agenda – and that we make scientific decisions based on facts, not ideology.</p>
<p>By doing this, we will ensure America’s continued global leadership in scientific discoveries and technological breakthroughs. That is essential not only for our economic prosperity, but for the progress of all humanity.</p>
<p>That is why today, I am also signing a Presidential Memorandum directing the head of the White House Office of Science and Technology Policy to develop a strategy for restoring scientific integrity to government decision making. To ensure that in this new Administration, we base our public policies on the soundest science; that we appoint scientific advisors based on their credentials and experience, not their politics or ideology; and that we are open and honest with the American people about the science behind our decisions. That is how we will harness the power of science to achieve our goals – to preserve our environment and protect our national security; to create the jobs of the future, and live longer, healthier lives.</p>
<p>As we restore our commitment to science, and resume funding for promising stem cell research, we owe a debt of gratitude to so many tireless advocates, some of whom are with us today, many of whom are not. Today, we honor all those whose names we don’t know, who organized, and raised awareness, and kept on fighting – even when it was too late for them, or for the people they love. And we honor those we know, who used their influence to help others and bring attention to this cause – people like Christopher and Dana Reeve, who we wish could be here to see this moment.</p>
<p>One of Christopher’s friends recalled that he hung a sign on the wall of the exercise room where he did his grueling regimen of physical therapy. It read: "For everyone who thought I couldn’t do it. For everyone who thought I shouldn’t do it. For everyone who said, ‘It’s impossible.’ See you at the finish line."</p>
<p>Christopher once told a reporter who was interviewing him: "If you came back here in ten years, I expect that I’d walk to the door to greet you."</p>
<p>Christopher did not get that chance. But if we pursue this research, maybe one day – maybe not in our lifetime, or even in our children’s lifetime – but maybe one day, others like him might.</p>
<p>There is no finish line in the work of science. The race is always with us – the urgent work of giving substance to hope and answering those many bedside prayers, of seeking a day when words like "terminal" and "incurable" are finally retired from our vocabulary.</p>
<p>Today, using every resource at our disposal, with renewed determination to lead the world in the discoveries of this new century, we rededicate ourselves to this work.</p>

<blockquote><p>Obama was to sign an executive order and memo Monday in an East Room ceremony, a long-promised move that would fill a campaign promise. Advisers said it was part of a broader declaration on science that would guide the administration's policies on matters ranging from renewable energy to climate change.</p></blockquote>
<p>According to the AP, the memorandum will not concern stem cells exclusively but also declare something about how "science" will trump "religious fable" in his "administration." Which I think is liberal code for, "abortions could cure Alzheimer's." Stay tuned.</p>
