Campaign Finance Office Won’t Hand Over Gray 2010 Report

Well, it was worth a shot. Despite requests from At-Large Councilmember and mayoral hopeful Vincent Orange, the Office of Campaign Finance says it still won't publish the Vince Gray 2010 campaign audit that it finished in May 2012.

OCF finished a draft of the unreleased audit a year and a half ago, on May 15, 2012. But in a Jan. 28 letter to Orange, Gray, and government operations chair Kenyan McDuffie, Board of Elections chairwoman Deborah K. Nichols writes that the final audit can't be produced until OCF gets evidence held by Ron Machen's U.S. Attorney's Office. LL got a copy of the letter, which reads:

As OCF has consistently reported in its presentations before the Board, during our monthly meetings, the documentation required in order to complete the enlarged Audit is in the custody of another enforcement agency, the United States Attorney's Office. Without access to this documentation, OCF cannot examine the physical evidence that is necessary to conclude its investigative process.

That's not stopping Orange. He'll introduce a symbolic resolution at Tuesday's Council meeting calling on OCF to release the report.

    Nichols makes a fair point Has OCF fo r formally asked Machen for the documents? Wouldn't Machen be pleased to turn over the documents to OCF? After all, wouldn't t make his investigation a it easier? If necessary, the DC COuncil has subpoena power. Why doesn't Orange call on the Council to issue three subpoenas: One to OCF, one to Machen and one to Gray personally? It can't hurt to ask.

    @ Drez:

    Do you believe that the Office of Campaign Finance (OCF)is disfuctional because its Director is inept or that its disfuctional by design/order? I believe that the latter is the case.

    Each D.C. Agency responsible for oversight and enforcement of District law is disfuctional when it comes holding District "officials" accountable for violations of law. But amazingly, they become very effective in holding the "citizens" accountable for violations of the law (i.e. Office of the Inspector General, Office of the Attorney General). This isn't a coincidence.

    I am no attorney, but I believe that the OCF remains the legal custodian of the records even though they have provided COPIES to the U.S. Attorney. Notwithstanding a Court order, I don't think that the OCF is precluded from providing the records to members of the Council simply because they've provided COPIES to the U.S. Attorney's Office.

    I am not sure, but I believe my point is worthy of consideration.

    Yes, I beleive the OCF is useless (at best) by design. I think they serve mostly to cover up for politicians. I can't recall a single incident they've been out in front on.

    WATCHDOG: You have NO BITE. What difference does it make where the Mayor's son works? If you want to go there, lets discuss Veronica "Hood Rat' Williams' $100k job in Fenty's office when she couldn't even pass the GED even though her man was the Mayor and should have been able to stack that deck as well.

    The first son has a degree from a highly prestigious institution. And about how much work he does? Your guy Fenty trained the triathlon during most of his entire administration. The current Mayor worked twice as long in his jobs as Chair of the Counsel and as now as sitting Mayor than Fenty, Nickles and Mz. HoodRat did throughout their collective and dubious careers.

    Muriel Bowser is less credible than Fenty was. At least he had his God Father to pull his puppet strings. That poor woman looks as if she's waiting to be exposed as the fraud she is and will probably be grateful for the chance to get off the puppet stage. Just like Adrian Fenty was.

    That man no more wanted to be re-elected Mayor than I did.
    He was afraid the of the midnight knock and moved as far away as he could to delay it. And hopefully, he still has that to look forward to. Though I doubt it because Nickles was an 'i dotting, t crossing' gangster and highly proficient puppet master.

    But wonders never cease and that crew may get what's coming to them after all. So they shouldn't rest too easily. At least somebody made them stop commenting with thinly veiled handles and probably made them stop commenting all together considering the consequences of being discovered by the long arm of the IT police.

    Why do you guys always direct your criticism towards Fenty when Gray's improprieties are being discussed? Fenty is not running for elected office and to the best of my knowledge, he's not under investigation. If he did commit violations of the law, maybe he will be held accountable. But the issue before us is Gray. And rightfully so. He is CURRENTLY under investigation and
    CURRENTLY running for re-election.

    Are you suggesting that those concerned about Gray's credibility, trustworthiness and suitability to hold office don't have good reason to be concerned?

    To # 17: Young man, what I am saying and (while I would never presume to be able to speak for the erudite & highly respected noodlez), what I think others and myslef are trying to tell you is that you and the other minions are doing a dis-service to due process under law in a system for which you proclaim steadfast belief and support.

    You espouse your pompous opinions, yet expect others not to have the right to do the same. You are a bully and you get very upset when you get your little behind smacked by your betters.     So lets start with Drez the usual conspiracy theory dude with no facts. First off OCF has actually held folks accountable. They went after Fenty's campaign. They went after the DC Young Democrats long before the Harry Thomas situation became public and they also have went after other groups. As usual you don't realize that the majority of their decisions don't make the news but are always available on their web site. Maybe you should start reading and stop telling folks to worry about their stages of grief.

    Not to Noodlez with your inept ass. First off Fenty was cleared of all charges on the so call contracts. What you still won't mention is that when Vincent Gray as Chair and Harry Thomas used Gray's White Lawyer to go after Fenty that they held up the report which cleared him until after the election. The report was originally supposed to come out before the Primary. But when they had the hearing on the Council in Thomas committee they pushed it back three times and they tried to cut of Bowswer and Cheh's microphones because they were calling Thomas and Gray out. The hearing took place in one of the small conference rooms on the first floor. The one on the left if you are facing the rooms.

    Further just because the AG had a second home (a farm) in VA doesn't mean he lived there. He had a home in the city and on some days he went to his farm to get away from the city.

    Further I notice that no one who is supporting Gray has mentioned that he kept almost all of Fenty's Department/Agency heads. You all are jokes for real.

    I support Gray and see absolutely no reason to bring up what is a rather common fact. That is, unless there's a change in political party, Dept heads usually remain for at least the 1st term.

    Check Bill DeBlasio for the most recent example.

    Really? No they didnt. They went after a write in campaign that had no shot and which Fenty himself disavowed after he lost the primary and ceased to be a major player in DC politics
    OFC has never gone after a viable politician. They are emasculated, weak, and purely for show.
    They've done nothing remotely controversial involving anyone remotely powerful.
