Nothing in this is NEW. Chief Lanier fired Kim Thorpe and others to keep them quiet about this and other illegal actions. Kim Thorpe is a Whistle Blower and as such should have been protected.

And the plaintiff's attorneys should contact Homeland Security as DC Police received millions of dollars in grant money to ensure the back-up and storage of such material. This case was filed well before the mandatory retention of these files had expired. OCTO has two storage locations, DC police has one in the JOCC, OCTO and one private off-site location.

Terry Ryan, Ron Harris, Cathy Lanier, Peter Newsham, Charles Ramsey, Phil Graham, Peter Nickles and Fenty -- all were aware and all participated in the obstruction, destruction, obfuscation...

"A lawyer shall not (a)Obstruct another party's access to evidence or alter, destroy, or conceal evidence, or counsel or assist another person to do so, if the lawyer reasonably should know that the evidence is or may be the subject of discovery or subpoena in any pending or imminent proceeding...(d)fail to make reasonably diligent efforts to comply with a legally proper discovery request by an opposing party" - Rules of Prof. Conduct, Rule 3.4, DC R RPC Rule 3.4

Can someone explain to me why Peter Nickles hasn't been disbarred?

None of this surprises anyone who litigates cases against the city. But it's nice to see the courts and the public finally taking notice. Will anything change? Stay tuned.

Well I guess we know why the district didn't want to produce anyone as records custodian now. I ask again, at what point does the DC Bar get involved with disbarment investigations? It seems that that those unaccounted for boxes of clearly relevant e-mails (after 7 years of litigation) alone should sufficient to end some careers.
